Who we are
This policy covers our shop at 19c Drawbridge Street, Cork City, T12 HT78, and our website www.amari.ie (together, "the Services"). Amari Shoes Limited, registered in Ireland, company number 638845 ("Amari", "we", "us") is the data controller of your personal information, which means we decide how and why it's used. Our website is powered by Shopify.
What we collect
- Contact details: your name, billing and delivery addresses, phone number and email address.
- Payment details: the payment method you used and your transaction records. Card payments are handled by our payment provider, so we don't see or store your full card number.
- Account details: your username, password and preferences.
- Order and shopping activity: items you view, add to your cart or wishlist, buy, return, exchange or cancel.
- Messages: anything you send us, such as a customer service enquiry.
- Device and usage information: your IP address, browser, device and how you move around the website, collected using cookies and similar technologies.
Where it comes from
We collect it from you directly (when you order, create an account or get in touch), automatically from your device when you use the website, and from the service providers who help us run the shop, such as Shopify, our payment provider and couriers.
Why we use it, and our legal basis
| What we do | Our legal basis |
|---|---|
| Process your order, take payment, arrange delivery, handle returns, exchanges and cancellations, manage your account | Contract: we need this to do what you've asked |
| Answer your questions and handle complaints | Contract and legitimate interests (looking after customers and resolving disputes) |
| Keep tax and accounting records, comply with the law, respond to lawful requests, establish or defend legal claims | Legal obligation and legitimate interests |
| Prevent fraud, secure the Services, protect our customers and business | Legitimate interests |
| Improve and tailor the Services, such as recommending products related to your purchases | Legitimate interests (running and improving our business) |
| Email or text you about similar products and offers if you've bought from us | Legitimate interests, with the right to opt out at any time |
| Marketing to people who haven't bought from us, non-essential cookies (analytics and advertising), and showing you ads online | Consent |
You don't have to give us your personal information, but we need certain details (your name, address and payment information) to fulfil an order, so we can't complete it without them. Where we rely on consent, you can withdraw it at any time. That won't affect anything we did before you withdrew it.
Who we share it with
- Shopify, which hosts the website and processes order data for us.
- Service providers who work for us under contract and can only use your information on our instructions, such as payment processing, couriers, IT support, cloud storage, accounting and email marketing (we use Omnisend).
- Advertising and social platforms, but only if you've accepted marketing cookies.
- Anyone you ask us to share it with, for example if you use a social media login.
- Revenue, An Garda Síochána, courts, regulators and our professional advisers, where the law requires it or where we need to protect or defend our rights.
- A buyer or successor, if we ever sell or merge the business. They'd be able to use your information only as this policy allows.
Our relationship with Shopify
For most purposes Shopify acts on our behalf. For some Shopify features, such as fraud analysis, Shopify uses information from your interactions with us and other merchants, and is responsible for that processing itself. You can read how at privacy.shopify.com/en, where you can also exercise your rights over that data.
Cookies
When you first visit, we'll ask whether you're happy for us to use non-essential cookies. Essential cookies (which keep your cart and checkout working) are always on. Analytics and marketing cookies are only set if you accept them. You can change your mind at any time using the "Cookie preferences" link in the footer.
International transfers
Shopify and some of our other providers operate outside Ireland and the EEA, for example in Canada and the United States. When your information leaves the EEA or UK, we rely on approved safeguards such as an EU adequacy decision or the European Commission's Standard Contractual Clauses (or the UK equivalent).
How long we keep it
| Information | How long |
|---|---|
| Order, payment and accounting records | 6 years, as required for tax and legal purposes |
| Account details | Until you close your account, or 3 years after your last activity |
| Customer service messages | 3 years after we last hear from you |
| Marketing details | Until you unsubscribe, after which we keep a record of your opt-out so we don't email you again |
| Cookie and analytics data | For as long as your cookie settings last, and no longer than our analytics provider keeps it |
We may keep information longer if we need it to resolve a dispute or comply with a legal obligation.
Keeping it safe
We use appropriate technical and organisational measures to protect your information. No system is completely secure, though, so please keep your account password private and avoid sending sensitive details, like card numbers, by email.
Your rights
Under EU and Irish data protection law you have the right to:
- see the personal information we hold about you
- have inaccurate information corrected
- ask us to delete your information
- ask us to restrict how we use it
- receive a copy in a portable format, or ask us to transfer it to someone else
- object to us using it, including for marketing (if you object to marketing, we'll stop)
- withdraw your consent where we rely on it
These rights aren't absolute and some only apply in certain situations. To use them, contact us using the details below. We may need to check your identity first. We'll reply within one month, and we may extend that by up to two further months for complex or multiple requests, in which case we'll let you know. Requests are free, but if one is clearly unfounded or excessive, we may charge a reasonable fee or decline it. You can also ask someone to make a request for you, but we'll need proof that you've authorised them.
We don't make decisions about you based solely on automated processing that legally or similarly significantly affects you. (Shopify's fraud tools may flag an order, but a member of our team reviews it.)
Marketing choices
You can unsubscribe from marketing emails and communications at any time using the associated link or by contacting us. We'll still send you service messages about your orders and account.
Children
Our Services aren't intended for anyone under 16, and we don't knowingly collect personal information from them. If you're a parent or guardian and think your child has given us their details, contact us and we'll delete them.
Links to other sites
Our website may link to third-party sites and social platforms. We don't control them and aren't responsible for their privacy practices, so please check their policies before sharing your information. Anything you post publicly on social media can be seen by others.
Complaints
If you're unhappy with how we've handled your information, please talk to us first, and we'll do our best to put it right. You also have the right to complain to the Data Protection Commission, 21 Fitzwilliam Square South, Dublin 2, D02 RD28 (dataprotection.ie), or to your local data protection authority.
Changes to this policy
We may update this policy from time to time for legal, operational or business reasons. We'll post the new version here and update the date at the top, and we'll tell you directly if the changes are significant.
